Depends on the model, some of the key types aren’t backordered. Some are.
They buy the info directly from the state (dmv or equivalent). Car purchase history is apparently public information, and they buy it in bulk.
Dealership is not involved, talk to your state reps if you want to stop it. Hint: they won’t, since it doesn’t affect them personally and it’s income for their state.

Tacoma keys were never part of this. Also, the keys that are backordered have to be programmed in person with the vehicle.
