The EU will extend temporary protection for Ukrainians fleeing Russia’s war until March 2028, while excluding newly arriving Ukrainian men of military age from the scheme.

Under the European Commission’s proposal, temporary protection would no longer be granted to newly arriving individuals who are not permitted to leave Ukraine because of military obligations under Ukrainian law.

    1951 Refugee Convention Art. 33:

    No Contracting State shall expel or return (“refouler”) a refugee in any manner whatsoever to the frontiers of territories where his life or freedom would be threatened on account of his race, religion, nationality, member- ship of a particular social group or political opinion.

    Charter of Fundamental Rights of the EU art. 19

    1. No one may be removed, expelled or extradited to a State where there is a serious risk that he or she would be subjected to the death penalty, torture or other inhuman or degrading treatment or punishment.
